The law does not protect employees who disclose classified information in an unauthorized manner. If an employee knows, or ought reasonably to know, that information is classified, the provisions of “whistleblower laws” should not protect that employee from the consequences of unauthorized disclosure. Answer: Decree 12958 of 17 April 1995 requires that a person may have access to classified information provided that he or she meets three requirements, one of which is the signing of an approved non-disclosure agreement.
