Note that there is a distinction between DEE agreements and personal advice agreements. There are personalized guidance agreements between an external body and a single faculty member. BU does not participate in personal advisory agreements and is not involved in the negotiation of these agreements. The General Council office cannot advise faculty members on personal advice agreements, but provides advice [here]. Past commitments with respect to existing agreements are maintained, including the requirement to keep a written record of the agreement for a period of five years. According to the updated guidelines, employers who ask workers to be “flexible” must enter into new written agreements confirming new agreements with these workers. From 1 July 2020, flexible agreements may be time-limited and can be concluded more than once with staff. If the following statements are correct, you may have an agreement on the FFS: it is very important that these solutions are developed in depth so that they are consistent with the health plan and the supplier`s objectives and incentives. Achieving mutual understanding and agreement (i.e. between the health plan and the provider) of the program`s objectives and the effective management of the required operational and technical capabilities are both essential and of equal importance for the success of the program. Implementation of these functions without reaching agreement on the objectives of the program does not achieve the program quality objectives and financial results desired by VBC.
Research at the BU should benefit the general public and/or advance the BU`s education and research mission, not just or primarily for the commercial interest of an outsider. Therefore, there should be only a limited fee for service work (outside service centres) at BU. While there may be scientific research or benefits for an FFS agreement, these benefits are probably not the primary objective of the activity and represent risks that need to be adequately managed. In the typical “service fee” agreement, the external agency requests ownership of the work product, results and reports and may attempt to impose confidentiality obligations on BU, including prior authorization for all publications.
